Proposed RulesArizona State Parks staff completed its Five Year Review of Rules in November of 2004. This review, approved by the Governor's Regulatory Review Council, identified 19 rules that were in need of revision. The docket for these 19 rules was opened on May 27, 2005 and no public comment has been received. Since that time, an additional rule was identified that needed slight revision. R12-8-301 consists of definitions and will be added to the Proposed Rule making in order to add a definition. In addition, Rules R12-8-122 and R12-8-125 are being substantially rewritten to address Special Use and Access Permits. If a member of the public wishes to make public comment, please visit the websites listed below and follow the instructions: A summary of the Five Year Rule Review and reasons for the proposed rulemaking is as follows: SUMMARY OF FIVE YEAR RULE REVIEWThe Arizona State Parks Board has, since its inception in 1957, promulgated rules pursuant to A.R.S. §41-511. Agency staff in the operation and maintenance of the Arizona State Parks System including the State Historic Preservation Office utilize these rules. The current rules are simple direct and provide clear guidelines for the public, park user, and park employee. With the few noted exceptions the current rules, as written, are adequate for Arizona State Parks to accomplish its legislative charge. The agency has had very few written or verbal complaints on the current rules. It has been Arizona State Parks policy and philosophy to constantly monitor the effectiveness and appropriateness of its rules. Agency staff have actively enforced these rules and most have been tested in local judicial systems. In completing the five-year rule review in accordance with A.R.S. §41-1056 and A.A.C. R1-6-108, the agency has identified the following rules that will require the rule amendment procedure in the next five years. These are: R12-8-101 - As this regulation provides basic definitions for all of the Arizona State Park Rules and Regulations this rule may need to be amended if law, operations, facilities or programs significantly change. It is the opinion of the Agency, that this rule needs slight editing for brevity, clarity and organization. R12-8-102 - After reviewing the text of this rule, it is the opinion of the Agency that a text change is necessary for grammatical and punctuation purposes. R12-8-104 - After reviewing the text of this rule, it is the opinion of the Agency that text change is necessary to allow for a broader and more efficient process for notifications of closures and/or restrictions. A slight amendment for grammar and punctuation is also needed. R12-8-105 - After reviewing the rule, it is the opinion of the Agency that the rule needs to be amended to allow each individual park to set its own Day Use hours as necessary and post them at park entrances. A revision for some text change may be indicated relating to grammar and terms. The intent or general context of the rule will not be altered. The rule will remain brief, clear and organized. R12-8-106 - After reviewing the rule, it is the opinion of the Agency that editing the rule for inclusion of newer facilities and punctuation is needed. R12-8-108 - After reviewing this rule, the Agency feels that due to changes in the Agency's fee structure, the 5-Visit passé needs to be deleted from the rule. A slight amendment for punctuation is also needed. R12-8-111 - After reviewing the rule, it is the opinion of the Agency that slight amendments for terms and grammar are needed. R12-8-112 - After reviewing the text of this rule, it is the opinion of the Agency that amendments for terms and grammar are needed. R12-8-113 - After reviewing the rule, it is the opinion of the Agency that editing the rule for terms and punctuation are needed. R12-8-114 - After reviewing the text of this rule, it is the opinion of the Agency that editing the rule for organization is needed. R12-8-115 - After reviewing the text of this rule, it is the opinion of the Agency that editing the rule for punctuation is needed. R12-8-116 - After reviewing the rule, it is the opinion of the Agency that editing the rule for punctuation is needed. R12-8-119 - After reviewing the text of this rule, it is the opinion of the Agency that editing the rule for terms is needed. R12-8-120 - After reviewing the text of this rule, it is the opinion of the Agency that editing the rule for terms is needed. R12-8-122 - After reviewing the text of this rule, it is the opinion of the Agency that editing the rule for terms and punctuation is needed. R12-8-124 - After reviewing the rule, it is the opinion of the Agency that a revision of the rule for grammar and terms is needed. R12-8-125 - After reviewing the rule, it is the opinion of the Agency that addition of some text is necessary to inform the general public of new application processes and availability. The Agency currently has adapted its inter-net page to include application forms, instructions, etc. Additionally, a slight change is required correct punctuation. R12-8-303 - After reviewing the rule, it is the opinion of the Agency that a revision of the rule for clarity is needed. R12-8-305 - After reviewing the text of this rule, the agency feels the rule needs to be edited to amend the language of the rule for updating, clarification and consistency. |
